The U.S. International Trade Commission has opened an investigation into Apple, Samsung and Google following patent-infringement allegations from California-based audio company BoomCloud 360. If the claims are upheld, the case could result in restrictions on imports of affected products into the United States.
BoomCloud 360 filed its complaint on August 14, 2026, and the USITC announced the investigation on September 16. The complaint concerns three patents that the company says cover spatial-audio processing technologies incorporated into devices from the three companies.
The patents cover audio-processing methods intended to create a broader, more precisely positioned sound field. The technologies cited include:
- Adjusting spatial components of audio signals.
- Compensating for differences between left and right speakers.
- Correcting interference between audio channels.
BoomCloud 360 is seeking a limited exclusion order, which could block imports of products found to infringe, alongside cease-and-desist orders that could limit their sale and distribution in the U.S.
No import ban is currently in force, and the opening of an investigation does not establish that any infringement occurred. The USITC has yet to determine whether the patents are validly implicated, while a final public list of potentially affected devices has not been disclosed.
Apple has separately filed a court action seeking a ruling that its products do not infringe BoomCloud 360's patents, creating a parallel judicial track alongside the trade investigation.
The USITC will assign an administrative law judge to assess the evidence and issue an initial determination, which the Commission may subsequently review. It must set a target completion date within 45 days of opening the investigation; that timetable and the specific products at issue remain the next key details to watch.
